Securities Law of the People’s Republic of China

Article 1 The present Law is formulated for the purpose of
regulating the issuance and transaction of securities, protecting
the lawful rights and interests of investors, safeguarding the
economic order and public interests of the society and promoting
the growth of the socialist market economy.Article 2 The present Law shall be applied to the issuance and
transaction of stocks, corporate bonds as well as any other
securities as lawfully recognized by the State Council within the
territory of the People’s Republic of China. Where there is no such
provision in the present Law, the provisions of the Corporation Law
of the People’s Republic of China and other relevant laws and
administrative regulations shall be applied. Any listed trading of
government bonds and share of securities investment funds shall be
governed by the present Law. Where there is any special provision
in any other law or administrative regulation, the special
provision shall prevail. The measures for the administration of
issuance and transaction of securities derivatives shall be
prescribed by the State Council according to the principles of the

adhere to the principles of openness, fairness and

Roger Federer made a winning return from a six-week break yesterday, beating Olivier Rochus of Belgium 6-3, 6-4 at his hometown Swiss Indoors tournament.
The top-ranked Federer looked rested and refreshed after last playing Sept. 20, when he helped Switzerland beat Italy in the Davis Cup.
“I was eager to come out and play again,” Federer said. “It’s especially nice to come back on tour with my home tournament where I have so many memories.”
Federer broke Rochus’ serve in the sixth game of the first set and fifth game of the second.
“I thought it was a good match for me. At key moments when I needed a serve, it was there,” Federer said.
Federer is chasing a fourth straight title at the ¢ã1.75 million (US$2.58 million) Swiss Indoors, where he once worked as a ballboy.
He will next play 51st-ranked Andreas Seppi of Italy, who rallied to beat Swiss wild-card entry Stephane Bohli 4-6, 6-1, 7-5.
Federer showed a little rustiness early on but created a break point with a forehand crosscourt winner past Rochus, with whom he won the Wimbledon boys’ doubles title in 1998.
Federer’s blistering forehand winner at 2-2 in the second brought another break point, which he took when Rochus netted.
Rochus saved a match point when Federer netted a forehand volley, but the defending champion took his second with a powerful serve that the Belgian returned wide.
Federer is seeded to meet No. 3 Novak Djokovic in the final. The Serb will play Germany’s Andreas Beck on Tuesday.
France’s Florent Serra, a lucky loser from qualifying, survived a barrage of 28 aces to beat Croatia’s Ivo Karlovic 7-6 (5), 6-4.
The 2.08-meter (6-foot-10) Karlovic has an ATP tour-leading 855 aces this year, but his second serve failed and he couldn’t break Serra.
The 71st-ranked Serra will next meet fifth-seeded Radek Stepanek of the Czech Republic, who beat Germany’s Rainer Schuettler 6-2, 6-0 in the late match. -
Liang, Thongchai to battle for Asian crown

The race for the Asian Tour’s Order of Merit crown has now come down to a race between Thongchai Jaidee of Thailand and China’s Liang Wenchong.
Liang emerged as the only remaining contender after finishing second at the Singapore Open on Sunday, where his earnings of US$555,550 bumped up his season’s haul to US$740,544 while Thongchai took his tally to US$937,658 after finishing tied 14th which was worth US$67,785.
With three counting events remaining on the Asian Tour, third-ranked Anthony Kang of the United States fell out of contention as he trails Thongchai by approximately US$537,394 while Liang is US$197,114 behind the leader who is chasing an unprecedented third Merit crown.
“I don’t know who will win the Order of Merit. I’m just focusing on myself. If I play bad and someone else wins the tournament I’m okay. I’ll keep trying my best,” said Thongchai, who won the Order of Merit title in 2001 and 2004.
The Thai star credited Liang for his fine finish where he chased winner Ian Poulter of England until the very end at Sentosa Golf Club.
“Liang has become a strong player. This was a tough week. We had early starts every day and played many holes as well (due to the weather delays). You cannot anticipate the weather here. It was very tiring. You play so many holes and then you cannot get into any momentum,” said Thongchai.
Hong Kong Open
Liang, China’s first Asian Tour No. 1 when he won the Merit crown in 2007, is optimistic about his chances of edging Thongchai to the coveted title. However, he will need to finish no lower than second at the US$2.5 million Hong Kong Open next week to keep his hopes alive.
“The Order of Merit race will now move to the Hong Kong Open which is our last big event (followed by the Cambodian Open and King’s Cup in Thailand). I’ll try to push Thongchai all the way to try and win the Order of Merit title again. I’ll look at my schedule to ensure I give myself a chance,” said Liang, who has two runner-up finishes this season.
“Overall, I’m satisfied and pleased with how I played all week and being in contention. It was good that I maintained my form the entire week. I will try to maintain my form for the rest of the year,” added Liang.
Scott Hend of Australia was the biggest mover when he leaped 44 places up to fourth on the Order of Merit. His tied-third finish in Singapore earned him US$281,500 giving him a total of US$354,391 this season.
India’s Jyoti Randhawa dropped one spot to fifth with earnings of US$318,350 while compatriot Gaganjeet Bhullar is sixth on US$308,916. -

Women’s tennis appears to be in good shape despite the sight of the world’s best players limping across the finish line in Doha, Qatar, last week, where the WTA Championships often resembled a dance of the walking wounded.
It was survival of the fittest in searing heat and suffocating humidity and while others wilted, American Serena Williams proved again that when she is fit and really wants something, she is still top of the food chain.
A slightly lighter schedule than some of her main rivals – she played 18 tournaments compared to the 27 for world No. 4 Caroline Wozniacki – was in evidence as Williams stormed to the Doha title to ensure she will end the year as world No. 1 for the first time since 2002.
Like the skyscrapers that are sprouting out of the desert in Doha’s dusty suburbs, the 28-year-old, who claimed her 10th and 11th grand slam singles titles this year in Melbourne and London, still looms large over the women’s game.
She was virtually faultless at the Khalifa Tennis Center where she pocketed almost one million pounds (US$1.64 million), winning five matches in six days for the loss of just one set, that against sister Venus in their round-robin clash.
“I wanted to stay consistently fit this year,” said Williams, whose brilliant year may yet end with a bitter ITF punishment for her foul-mouthed tirade at a female line judge at the US Open.
“I had a little hiccup in March, but I put myself back together and I kept going.”
By the time they met again in Sunday’s final, Venus’s tank was empty while Serena was merciless, giving up just seven points on serve in her 6-2, 7-6 (4) victory. Her post-match comment that she didn’t expect to win the title fooled nobody. She is back where she feels she belongs.
Despite the WTA’s new road map that has lessened the load for the game’s top players, the US$4.5 million Doha showpiece was marred by injuries and rows of empty seats. Hardly a player in the draw, it seemed, did not require the on-court physio and local bandage suppliers would have done a roaring trade as knees and thighs were strapped.
Of the 10 players who took part, four pulled out, including Wozniacki against Serena and Belarusian Victoria Azarenka against Agnieszka Radwanska, who replaced Vera Zvonareva – who replaced Dinara Safina.
Nonetheless, Wozniacki and Azarenka provided the match of the tournament, a three-hour ding-dong that showed they will be pushing hard for grand slam titles next year. So too will Kim Clijsters, the Belgian mum who returned in spectacular fashion to win the US Open, and her compatriot Justine Henin who also decided that a life away from the adrenaline-fuelled world of top flight tennis was not for her.
The WTA will hope that the rich pool of talent at its disposal helps win over a new sponsor should mobile phone company Sony Ericsson decide not to renew its lucrative six-year deal that runs out at the end of next year. -

The World Anti-Doping Agency (WADA) wants to investigate whether any charges can be brought against Andre Agassi following his admission that he lied after taking crystal meth in 1997 and failing a drugs test.
Agassi’s revelations in extracts of his autobiography “Open”, published last week in The Times newspaper in Britain, stunned the tennis world and cast a shadow over the eight-times grand slam champion’s glittering career.
“He took something from the banned list in 1997, we can’t do much about that because it’s outside the statute of limitations, the eight-year bar,” WADA director general David Howman told Reuters on Sunday.
“Two things need a little bit more inquiry, if he’s lied, and he’s confessed he lied, so he’s obviously lied and he lied under oath then I think that warrants further investigation to see whether there might be any other charges.
“We all know about Marion Jones, she lied to a tribunal, it can’t just be one of those things you get away with,” he added in reference to the American sprinter who served a six-month prison term for lying to federal prosecutors about her drug use.
“The second issue is, he had a lawyer represent him, does his lawyer know that he was lying?
“Maybe something can be done in relation to that.”
After failing a drugs test, Agassi wrote a letter to the ATP asking for leniency because he had accidentally drunk a “spiked soda” belonging to his assistant.
Agassi received no punishment from the governing body of men’s tennis.
WADA has an eight-year limit on punishment for doping offences but last week former Ukraine pole vaulter Sergei Bubka, a committee member on the International Olympic Committee (IOC) said Agassi should be penalised for taking banned substances.
“It may not be something the ATP has any jurisdiction over. It may be that some other agency has to look at it,” Howman said. “We just don’t rely on sport to sanction for doping offences.
“These things have to be pursued,” Howman added. “You don’t just take them at face value, that it’s outside the eight-year limit so nothing can be done. You’ve got to say maybe something else can be done.” -

American Doug Barron became the first golfer to be banned for taking a performance-enhancing drug on Monday.
The PGA Tour said in a statement that Barron, 40, had been suspended for a year for violating its anti-doping policy.
The drug was not named in the statement. -

Ukrainian qualifier Sergiy Stakhovsky lifted his second ATP title on Sunday as he edged out eighth-seeded Argentine Horacio Zeballos 2-6, 7-6, 7-6 in the St. Petersburg Open final.
Zeballos, playing in his first ATP final, led 3-0 in the second-set tiebreaker but 93rd-ranked Stakhovsky clawed back six straight points, winning it 10-8 to level the match.
Stakhovsky, whose first title came last year in Zagreb, broke for a 4-3 lead in the third set and had a match point in the ninth game but Zeballos held before breaking back.
In the deciding tiebreak, both players held match points before the 23-year-old Kiev native finally sealed victory 9-7.
